1. About these terms

TreeServicesNear.me (the "site") is run by LS Marine Services, a company registered in Grenada, of Lance aux Épines, St. George, Grenada ("we", "us"). By using the site you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.

2. What the site is

The site is an independent directory of tree service companies in Florida, with guides for homeowners. It is free for homeowners to use.

• We are not a contractor. We do not carry out, supervise or arrange tree work, and we do not employ or act for any listed company.
• We do not vet listings. Listings are built from public business information. We do not check licences, insurance, credentials, workmanship or the truth of anything a company says about itself. Details shown as stated by a company are that company's own statements.
• A listing is not an endorsement. Being listed, or being shown higher in a list, does not mean we recommend a company.
• Featured listings are paid placements. Each town has one Featured spot, which a company pays for. It is labelled and shown first. See section 7.
• Ratings are Google's. Star ratings and review counts come from Google, are not collected or checked by us, and may be out of date.

3. Guides, calculators and diagrams

The guides, cost calculators, checklists and diagrams on the site are general information for Florida homeowners. They are not legal, insurance, arboricultural or safety advice for your situation.

• Prices are ballpark estimates. They are not quotes, and no listed company is bound by them.
• Laws and local tree rules change, and they differ between cities and counties. The official source is the authority, not our summary of it.
• A tool on this site cannot assess a real tree. If a tree may be dangerous, have it looked at on site by a qualified arborist, and call 911 in an emergency.

We work to keep this information accurate and we correct mistakes we are told about, but we do not promise that it is complete or current.

4. Dealing with listed companies

Any agreement to carry out work is between you and the company you hire. We are not a party to it, we take no commission, and we are not responsible for a company's work, prices, conduct, or any loss or damage arising from it.

Before you hire, make your own checks. At a minimum: a certificate of insurance sent to you by the company's insurer, proof the business is registered, recent reviews, and a written quote. Our guide on how to choose a tree service explains how.

If you send an enquiry through a listing, we pass it to that company so it can reply to you. We do not promise that a company will respond.

5. Using the site

You agree not to:

• copy the directory in bulk, by scraping or any automated means, to build a competing database or send marketing;
• send false, abusive or unsolicited commercial messages through any form;
• claim or edit a listing for a business you are not authorised to represent;
• interfere with the site's operation or security, or try to reach parts of it that are not public.

Search engines and AI assistants may read and cite the site's public pages in the normal way.

6. For businesses: your listing

• Being listed. We list businesses using publicly available information. A basic listing is free.
• Correction and removal. You can ask us at any time to correct your listing or remove it, whether or not you have claimed it. Use the contact form.
• Claiming. When you claim a listing, you confirm that you own the business or are authorised to act for it. We may ask for proof and may refuse or reverse a claim.
• Your edit link. Your private edit link gives access to your listing. Keep it confidential and tell us if you think someone else has it.
• What you publish. You are responsible for what you add to your listing. It must be accurate, lawful and yours to use. Do not state a licence, insurance, certification or award that you do not currently hold, and do not upload photos you do not have the right to use.
• Permission to display it. You keep ownership of what you add. You give us permission to display, resize and reformat it on the site and in material that promotes the site, for as long as your listing is live.
• Our right to edit or remove. We may edit, hide or remove any listing or content that we believe is inaccurate, misleading, unlawful or in breach of these terms.
• Enquiries you receive. Use customer details from an enquiry only to respond to that customer about their request.

7. For businesses: paid services

Featured listings

• What it is. One company per town is shown first on that town's page, on a larger card, labelled Featured. It is also shown first on that town's service pages, and among the Featured companies on its county page.
• Free for a link, while a town is small. Until a town's pages reach 100 views in 30 days, the Featured spot there cannot be bought. Instead, the first claimed company to place a link to TreeServicesNear.me on its own website, and confirm it from its edit page, receives the spot free. We check that the link is still there about once a month. If it is missing, we email the owner, and if it is not back within 14 days the spot is released to the next company.
• Paid, once a town has traffic. When a town's pages reach 100 views in 30 days, Featured there becomes a paid spot at $99 for 12 months, starting on the day your payment is received (or, when you renew early, on the day your current term ends). Payment is made by PayPal or card on your edit page. A company holding the spot for a link at that point keeps it free for a further 3 months, and can then pay to keep it. You can also buy Featured in any other town your listing appears in, at the same price per town; the free-for-a-link offer applies to your home town only. Prices are in US dollars.
• How views are counted. One view per visitor, per town, per day, after the page has been on screen for a few seconds. Search engines, bots and our own visits are not counted. Our count is final.
• Availability. If the spot is taken, you can join the waiting list. When a paid spot comes free, it is held for the first company on the waiting list for 7 days; if they do not pay in that time, they leave the list and it is held for the next. When nobody is waiting, the spot goes to the first company whose payment we receive.
• Renewal. Paid Featured listings do not renew automatically and we do not hold payment details. We email a reminder before the term ends. If it is not renewed, the listing returns to a standard listing and the spot may be offered to another company.
• Refunds. If you change your mind, ask within 14 days of paying and we will refund you in full. After 14 days, payments are not refundable. If we end a paid Featured listing early for a reason that is not your breach of these terms, we will refund the unused part.
• No guarantee of results. We do not promise any number of views, calls, enquiries or customers, or any position in search engines.
• Our right to end it. We may end a Featured listing, free or paid, without refund if the business has given false information, has closed, or has seriously breached these terms.

Websites and hosting

If we build or host a website for your business, that work is covered by a separate written agreement, which takes priority over these terms for that work.

8. Ownership of the site's content

The site's text, design, diagrams, tools and the way the directory is compiled belong to us or to those who license them to us. You may quote short passages with a link back to the page. You may not reproduce substantial parts of the site without our written permission. Business names, logos and photos belong to their owners.

9. Links to other sites

The site links to company websites, Google, government pages and other sources. We do not control those sites and are not responsible for what is on them.

10. No warranties

The site is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, about the site, its content, or any listed company, including warranties of accuracy, fitness for a particular purpose and non-infringement. We do not promise that the site will always be available or free of errors.

11. Limits on our liability

To the fullest extent the law allows:

• we are not liable for the acts, omissions, work, prices or conduct of any listed company, or for any dealings between you and a company;
• we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, business or data;
• our total liability to you for all claims connected with the site is limited to the greater of the amount you paid us in the 12 months before the claim arose, or 100 US dollars.

Nothing in these terms limits liability that cannot be limited by law.

12. Claims caused by your use

If someone brings a claim against us because of content you added to a listing, a claim you made about your business, or your breach of these terms, you agree to cover our reasonable costs and losses arising from that claim.

13. Changes

We may update these terms. The new version applies from the effective date shown at the top of this page. If a change materially affects a business with a claimed or Featured listing, we will email it before the change takes effect. A Featured term that has already been paid for continues on the price and placement it was bought with.

14. Governing law

These terms are governed by the laws of Grenada. Any dispute connected with them or with the site will be brought in the courts of Grenada, unless the law where you live gives you the right to bring it elsewhere or to rely on its own consumer protections.

15. General

If any part of these terms is found to be unenforceable, the rest still applies. If we do not enforce a term on one occasion, we can still enforce it later. These terms, with the Privacy Policy and any separate written agreement for website work, are the whole agreement between you and us about the site.
